B. Declaration by Season Badge Applicant

• By submitting this Confirmation to The Hong Kong Jockey Club (“the Club”) to confirm my intention of using the season badge for the season 2021/22 issued under The Hong Kong Jockey Club Privilege Programme and The HKJC Priority Programme, I am deemed to have read and agreed to strictly observe the following:
  i. The terms and conditions of this Confirmation;
  ii. The terms and conditions of The Hong Kong Jockey Club Privilege Programme and The HKJC Priority Programme;
  iii. The Season Badge Bye-laws, the Race Day Bye-laws and such other applicable bye-laws and regulations as issued by The Hong Kong Jockey Club (“the Club”) from time to time (available on this website); and iv. Any other laws applicable
• Without prejudice to the generality of Clause 1 above, I acknowledge and undertake that:
  i. By receiving and using the Season Badge for the season 2021/22 as issued to me under The Hong Kong Jockey Club Privilege Programme and The HKJC Priority Programme, I will acquire no Membership or any Member rights of the Club;
  ii. I will observe the aforesaid Bye-laws as issued by the Club from time to time notwithstanding that I am not a Member of the Club;
  iii. My rights to use the Season Badge issued for me shall also be subject to the terms and conditions of The Hong Kong Jockey Club Privilege Programme and The HKJC Priority Programme;
  iv. I will be abode by Bye-laws (10) to (12) of the Season Badge Bye-laws and waive any right to an enquiry if any of the said Bye-laws are enforced to my detriment; and
  v. Pursuant to Bye-laws 8(e) of the Season Badge Bye-laws, the Stewards of the Club, in their discretion, may restrict the areas to which access is permitted and I expressly hereby waive any rights which may be conferred by law should the Stewards reduce the areas specified or, having increased the areas specified, reduce the increased area.
• I acknowledge that Section 25(2) of the Gambling Ordinance provides as follows:
  “A person authorized for the purpose of this section by a racing club may, if he has reason to suspect that a person is committing an offence under section 7 or 8 on the racing club premises, require such person to leave the premises and, if he fails to do so, remove him therefrom.”
  If, in fulfilment of the statutory duty imposed on the Club by section 25 of the Gambling Ordinance, I am ejected from the premises of the Club and the Season Badge issued to me is revoked by the Club, I hereby acknowledge that I shall not be entitled to any compensation in whatsoever form from the Club and I hereby agree to waive any right to claim against the Club in whatsoever way.
• I acknowledge that issuing a season badge for the season 2021/22 to me is at the Club’s absolute discretion and my submission of this Confirmation to the Club does not compel the Club to consider this confirmation or issue the season badge for the season 2021/22 to me.
• In the event of dispute, the Club’s decision and interpretation in connection with these terms and conditions shall be final.
• In the event of any inconsistencies between the Chinese and the English versions of this Confirmation, the English version shall prevail.
